These Terms of Use ("Terms") govern your access to and use of falconeroperations.com (the "Site"), operated by Falconer Operations Group LLC ("Falconer," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site for lawful, informational purposes only. You agree not to use the Site to (a) violate any applicable law, regulation, or contract; (b) infringe the intellectual property or other rights of any party; (c) interfere with the operation or security of the Site; (d) attempt unauthorized access to any system or data; or (e) introduce malware, scripts, or other harmful code.

2. No professional engagement created

Content on the Site is provided for general informational purposes only. Nothing on the Site creates a contractor relationship, engagement, attorney-client relationship, fiduciary relationship, or any other professional relationship between Falconer and you. Range safety analyses, engineering services, and other Falconer deliverables are provided only under written agreement.

3. Intellectual property

The Site and its content — including text, graphics, logos, illustrations, the Falconer mark, the UAS Composite WDZ visualization, source code, design tokens, and trade dress — are owned by Falconer Operations Group LLC or its licensors and protected by U.S. and international intellectual-property laws. You may view, save, and print individual pages for non-commercial personal or business-evaluation use. Any other use, including reproduction, modification, distribution, public display, framing, scraping, or use for AI training, requires our prior written permission.

4. Third-party content and links

The Site may reference or link to third-party materials, government publications (e.g., DA PAM 385-63, AR 350-19, TC 25-8, MCO 3570.1C), and external websites. Such references are provided for convenience and identification only and do not imply endorsement. Government publications cited remain in the public domain or under the rights of their respective publishers. Falconer is not responsible for the content or availability of third-party sites.

5. Federal contracting representations

Falconer is a Virginia-formed LLC and an SDVOSB pending SBA certification. Statements on the Site regarding socioeconomic status, contract vehicles, certifications, clearances, and past performance reflect our good-faith understanding as of the Effective Date. Authoritative status records are maintained in SAM.gov and the SBA's certification systems. In the event of any inconsistency, the authoritative system of record controls.

6. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Falconer disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or virus-free.

7. Limitation of liability

To the fullest extent permitted by law, Falconer, its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the Site. Our aggregate liability for any claim arising out of these Terms or the Site is limited to one hundred U.S. dollars (US $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Falconer from and against any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

9. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Any dispute arising under or related to these Terms or the Site will be brought exclusively in the state or federal courts located in or serving Newport News, Virginia, and you consent to the personal jurisdiction and venue of those courts.

10. Changes to the Site and these Terms

We may modify or discontinue the Site, or update these Terms, at any time without notice. Continued use of the Site after changes constitutes acceptance of the revised Terms. The current version is the one posted on this page.
